NRI & OCI Gurugram property buying checklist
A practical, source-led checklist for NRI and OCI buyers: legal eligibility, bank payments, HRERA verification, remote visits, tax and documentation.
What is different when an NRI or OCI evaluates a Gurugram home?
Start by confirming your residency and citizenship category, permitted property type and payment route. RBI guidance distinguishes residential/commercial property from agricultural land, plantation land and farmhouses. Do not rely on a broker's statement alone for FEMA compliance.
1. Eligibility
Confirm your NRI/OCI category and whether the property type is permitted under the current RBI/NDI framework.
2. Project verification
Match marketed name to the exact HRERA registration, tower and promoter; check recorded status and registered dates.
3. Money trail
Ask your bank for permitted NRE/NRO/FCNR(B) or remittance payment pathways, receipts and repatriation rules.
4. Execution
Determine who will inspect, sign and register documents in person or under properly vetted authority.
Before paying a booking amount
- Request the developer's current phase-specific cost sheet and signed offer terms.
- Get the tower, unit number, sanctioned layout, usable area basis and HRERA project ID in writing.
- Check approved sale agreement, instalment milestones, cancellation charges and refund policy.
- Confirm the exact bank account and legal receiving entity; avoid third-party personal payment requests.
- Review stamp duty, registration charges and all taxes with a qualified local adviser.
- Check your residency, seller's residency and applicable TDS reporting under current tax law; tax forms changed in October 2026.
- Arrange independent title/document due diligence and obtain verifiable payment receipts.
- For remote visits ask for dated walk-through evidence, not only undated renders.
- Use a written power-of-attorney process only after local legal review; never send signed blank documents.
- Choose the correct response window and a trusted recipient for document delivery and post-handover support.
Four smart questions for a remote video walkthrough
Ask the presenter to show the approach road, actual main entrance, distance between sample unit and promised amenities, and any ongoing construction immediately outside. Request date and location confirmation. A marketing video does not prove occupancy, certificate status or unit condition.
RERA registration vs possession
A project's registration up-to date is not itself the contractual possession promise for a particular apartment. Check the actual unit/tower and the signed agreement. For Westin / Urban Resort in Sector 103, separate official phases have different registration dates; use the Westin phase-check guide instead of a generic date.
Primary sources and next verification steps
- RBI guidance on property acquisition by NRI/OCI
- Haryana RERA registered projects
- Income Tax Department – official TDS/property transfer help
Official sources can change. Record the verification date and keep copies of the documents used for a specific unit.
